Father and son 'battered prowler to death'
5/ 2/2002
A FATHER and son became the ''judge, jury and executioner'' when they battered a prowler to death outside their homes, a jury heard.
Alan Lisle, 63, and his 37-year-old son Anthony used a metal shovel and a stave to beat the man around the head in front of police.
The attack only stopped when Anthony Lisle was dragged off the defenceless man and he and his father were told to drop their weapons.
The victim was rushed to hospital, but had suffered brain damage and died later when his injuries caused a heart attack.
It was claimed 33-year-old Mr Brown and two pals had been hanging around outside Anthony Lisle's home and one of them threw a brick at a window.
Police were alerted by Lisle, but while waiting for them to arrive, he and his father armed themselves and attacked and murdered Mr Brown, it was alleged at Manchester Crown Court.
''Revenge or rough justice meted out with a stave or a spade by angry householders is not permitted in a civilised society,'' said prosecutor Peter Wright QC.
''The fact that you may perceive yourself to be the victim of a criminal act does not entitle you literally to beat the living daylights out of someone and to be judge, jury and executioner in your own cause.''
Mr Wright was outlining the Crown's case against the Lisles, who deny murdering Mr Brown near their homes in Herries Street, Ashton under Lyne, last August.
Emergency call
He told the jury the victim and two other men had been ''up to no good'' that evening and Anthony Lisle had made an emergency call to police complaining they were near his home.
The three men had also been seen by a passer-by, who was ''suspicious'' because of the way they were acting and he had also spotted Mr Lisle, dressed only in his underclothes, watching them.
Police searched the area, but the men had gone - then 90 minutes later, Anthony Lisle made a second emergency call to say a brick had been thrown at a window.
Mr Wright alleged that before police arrived, Antony Lisle and his father, who lived close by, then took the law into their own hands.
As police approached, they saw Alan Brown and his friends in the roadway with Anthony Lisle and his father in front of them, said Mr Wright.
''The officers watched incapable of doing anything as Anthony Lisle and his father proceeded to strike Mr Brown repeatedly with the weapons they had in their hands.
''Mr Brown collapsed, but this did not deter the men, who . . . proceeded to repeatedly beat him about the head and body.''
He said Anthony Lisle was then dragged away and he and his father were arrested.
But Mr Wright told the jury both men had attacked Brown because they were ''enraged'' over what he and his friends had done.
